Please read these terms before using Sway. By downloading or using the app, you agree to them.
1. What Sway is
Sway is a mobile application that provides guided stretching routines. It offers illustrated stretches with timers, voice cues, and a record of the sessions you complete.
Sway is a general fitness and wellness tool. It is not a medical device, a diagnostic tool, or a substitute for professional care.
2. Health and safety
This is the most important section of these terms.
Sway does not provide medical advice. The stretches, instructions, and guidance in the app are general information only and are not tailored to your body, your medical history, or any condition you may have.
Before starting Sway, or any new physical activity, you should consult a physician or a qualified healthcare professional — particularly if you:
- have or suspect an injury
- have a musculoskeletal, cardiovascular, neurological, or other medical condition
- are pregnant or recently gave birth
- have recently had surgery
- are recovering from an illness
- take medication that affects balance, blood pressure, or coordination
- are over 65 or have not exercised regularly for some time
While using Sway:
- Move gently and within a comfortable range. Never force a stretch.
- Stop immediately if you feel pain, dizziness, numbness, tingling, shortness of breath, or anything that does not feel right.
- Skip any stretch that does not feel appropriate for your body on a given day.
- Do not use the app while driving, or anywhere that requires your attention.
You use Sway at your own risk. You are responsible for exercising your own judgement about what is safe for your body.
3. No professional relationship
Using Sway does not create a doctor-patient, physiotherapist-patient, or trainer-client relationship between you and us. We do not know your medical history and cannot assess whether any particular stretch is right for you.
4. Your licence to use the app
We grant you a personal, non-transferable, non-exclusive licence to use Sway on devices you own or control, for your own non-commercial use, in accordance with these terms and Apple's App Store Terms of Service.
You may not:
- copy, modify, reverse-engineer, or create derivative works from the app
- extract, redistribute, or republish the app's illustrations, routines, or written content
- use the app's content in another product or service
- rent, lease, sell, or sublicense the app
5. Purchases
Sway is free to download and includes three routines. Sway Pro is a one-time, non-consumable in-app purchase that permanently unlocks the remaining routines for as long as Sway is available. There is no subscription.
Sway Pro is sold and processed by Apple. Payment, billing, and refunds are handled by Apple under its own terms, not by us. To request a refund, contact Apple.
Your purchase is tied to your Apple Account and can be restored on your devices signed in to that account, using Restore Purchases in the app's settings or on the Sway Pro screen.
6. Our content
The illustrations, routines, written instructions, name, and design of Sway are owned by us or licensed to us, and are protected by copyright and other intellectual property laws. Nothing in these terms transfers any ownership to you.
7. Your data
Sway stores your session history and preferences on your device. It does not transmit them anywhere. See our Privacy Policy for details.
Because your data is stored only on your device, you are responsible for it. Deleting the app deletes your history permanently, and we cannot recover it.
8. The app is provided as is
Sway is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or that its content is complete or suitable for your circumstances.
9. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for any injury, loss, or damage — including indirect, incidental, special, consequential, or punitive damages, or any loss of data — arising from your use of, or inability to use, Sway.
Where liability cannot be excluded under applicable law, our total liability is limited to the amount you paid for the app and any in-app purchases, or the minimum permitted by that law.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is the case, the exclusions and limitations above apply only to the extent permitted.
10. Changes
We may update these terms as the app develops. When we do, we will change the date at the top of this page. Continuing to use the app after an update means you accept the revised terms.
We may also modify, suspend, or discontinue the app or any of its features.
11. Termination
You may stop using Sway at any time by deleting it. We may terminate your licence if you breach these terms.
12. Governing law
These terms are governed by the laws of Morocco, without regard to conflict-of-law rules. Nothing here limits any consumer rights you have under the mandatory law of your country of residence.
13. Apple
Apple is not a party to these terms and has no obligation to provide support for Sway. Your use of the app is also subject to Apple's App Store Terms of Service.
